Terms of Use

1. Definitions

“SkyVanguard” / “we”: the service provider. “NEO”: the autonomous cybersecurity agent and related services. “Site”: skyvanguard.com.py. “You” / “Customer”: the person or company using the site or contracting a service.

“Free assessment”: the free, limited analysis of a domain’s exposed surface. “Subscription services”: the continuous monitoring contracted under a plan. “Surface” / “hosts”: the internet-observable assets associated with a domain.

2. Acceptance and capacity

By using the site or services you represent that you have the legal capacity to be bound by these terms and, if acting on behalf of a company, that you are authorized to do so.

3. Service description

NEO discovers what an organization exposes to the internet, identifies risks and delivers executive reports. The free assessment is a limited sample; subscription services provide continuous monitoring according to the contracted plan.

The service is a security support tool and does not replace a full audit, a complete manual pentest or professional judgment.

4. Scope of the free assessment

The free assessment is limited to information observable from the internet: discovery of public assets and light analysis of the surface.

It performs no vulnerability exploitation, brute forcing, denial of service, system access or any intrusive or destructive action.

5. Requester authorization and responsibility

By requesting an assessment you represent and warrant that you own the domain or hold express authorization to request its analysis.

SkyVanguard acts in good faith on your declaration and does not verify ownership in the free assessment. Responsibility for requesting the analysis of a domain without the authority to do so lies solely with the requester.

6. Subscription services

Continuous monitoring services are governed by the contracted plan, which defines the covered surface, frequency and included features.

NEO monitors continuously and completes analyses within the windows defined by the plan; unless expressly agreed, uninterrupted availability is not promised.

7. Account and accuracy of information

You must provide accurate information and keep it up to date, including a valid email. You are responsible for the use made of your credentials or access.

8. Pricing, billing and taxes

Prices for subscription services are stated at the time of contracting and billed recurrently according to the plan cycle.

Prices are expressed in guaraníes; applicable taxes (VAT) are indicated at contracting. Non-payment may lead to suspension of the service.

9. Term, renewal and cancellation

Subscription services renew according to the contracted cycle, unless cancelled with the notice stated in the plan. The free assessment creates no obligation to contract.

10. Acceptable use

You may not use the service to analyze third-party domains without authorization, for unlawful purposes, or to violate the rights of others. You may not attempt to interfere with, copy, reverse engineer or compromise the service, the model or the infrastructure.

SkyVanguard may reject, limit, suspend or cancel requests upon signs of abuse.

11. No completeness warranty

Reports reflect what was detected at analysis time and do not guarantee identification of every vulnerability or the absence of risk. The service is provided “as is” and “as available”.

12. Intellectual property

The service, software, AI model, brand and all associated material are the property of SkyVanguard and protected by law. These terms transfer no intellectual property rights.

You are granted a license to use the reports you receive internally within your organization; you may not resell or redistribute them without authorization.

13. Confidentiality

Each party will treat the other’s non-public information accessed in connection with the service as confidential, and use it only to provide or receive the service.

14. Personal data protection

The processing of personal data is governed by our Privacy Policy, which forms part of these terms. Public information is not automatically valueless: reports, correlations and history can be sensitive and are treated as such.

15. Limitation of liability

To the extent permitted by law, SkyVanguard shall not be liable for indirect, incidental or consequential damages, or for lost profits, arising from the use of or inability to use the service or the reports.

SkyVanguard’s total liability, if any, shall not exceed the amount paid by the Customer for the service in the three months prior to the event giving rise to the claim.

16. Indemnity

You agree to hold SkyVanguard harmless from third-party claims arising from misuse of the service or from requesting the analysis of a domain without proper authorization.

17. Suspension and termination

SkyVanguard may suspend or terminate access upon breach of these terms, signs of abuse or non-payment. You may stop using the service at any time, without prejudice to obligations already accrued.

18. Changes

We may update these terms and the service. Material changes will be communicated through the site or by email. Continued use of the service implies acceptance of the terms in force.

19. Force majeure

SkyVanguard shall not be liable for failures caused by events beyond its reasonable control (power or network failures, provider outages, force majeure events).

20. Assignment, severability and entire agreement

You may not assign these terms without our consent. If any clause is invalid, the rest remains in force. These terms, together with the Privacy Policy and the contracted plan, constitute the entire agreement between the parties.

21. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Paraguay, and the parties submit to the jurisdiction of its competent courts.
